Private-property towing and booting rules should be clearly posted before enforcement.
Maximum Fees
States should establish reasonable maximum towing, booting, storage, and administrative charges.
Evidence
Towing companies should document the violation with:
photographs;
location;
date;
time;
legal authority for tow or boot.
Prompt Notice
Vehicle owners should receive prompt notice explaining:
where the vehicle is located;
why it was removed;
charges;
retrieval procedure;
appeal rights.
Retrieval Access
Owners should have reasonable access to retrieve vehicles without unnecessary additional storage charges caused solely by limited business hours.
Appeals
Consumers should have access to a fast, low-cost process to challenge improper towing or booting.
Kickbacks
Property owners, managers, and towing companies should not receive improper financial incentives tied to maximizing the number of vehicles towed or booted.
Airline Passenger Rights
Automatic Refunds
Passengers should receive automatic refunds where required by law following qualifying airline-caused cancellations or major itinerary failures.
Consumers should not have to repeatedly request money they are already legally owed.
Major Delays
Congress should establish clear rules for airline-caused major delays, including when compensation, meals, lodging, or rebooking responsibilities apply.
Baggage
Airlines should provide transparent and timely compensation procedures for:
lost baggage;
substantially delayed baggage;
damaged baggage.
All-In Pricing
Displayed airfare should reflect mandatory charges consistent with MPA's general all-in pricing policy.
Towing and Booting
A private tow or boot must be supported by timestamped photographs, location, stated violation, legal authority, operator identity, and an itemized fee statement. The vehicle's location and retrieval instructions must be entered into an accessible notice system within 30 minutes. If the operator does not provide reasonable round-the-clock release access, storage charges may not accrue solely because the facility is closed. A low-cost hearing must be available within 10 business days, with a refund issued within five business days after an improper tow is established.
Airline Refunds and Controllable Disruptions
Required refunds must be automatic and returned within seven business days for credit-card purchases and 20 calendar days for other payments. When an airline-controlled disruption causes an overnight delay, the airline should provide reasonable rebooking, meals, and lodging. Weather, air-traffic-control restrictions, security emergencies, and other events genuinely outside the carrier's control may be treated differently, but the passenger retains any refund right created by cancellation or a major itinerary change.
