PROPOSED / DRAFT — PSYCHIATRIC HOSPITAL CAPACITY, CARE & TRANSPARENCY
America should maintain sufficient modern psychiatric hospitals, crisis-stabilization centers, secure treatment capacity, and community step-down services so people with serious mental illness can receive appropriate care instead of being abandoned, jailed solely because treatment is unavailable, or placed in unsafe facilities.
Facilities must protect patient dignity, bodily safety, privacy, communication, access to counsel and advocates, clinically appropriate treatment, family involvement when authorized, and strong due-process protections for involuntary admission, medication, restraint, seclusion, and continued confinement.
Public and private psychiatric facilities receiving public funds or exercising involuntary authority should be subject to independent licensing, unannounced inspections, transparent quality reporting, financial audits, staffing and training standards, mortality and serious-incident review, abuse reporting, evidence preservation, complaint procedures, corrective-action plans, and meaningful penalties for neglect, fraud, or mistreatment.
Public reports should protect individual medical privacy while showing whether facilities deliver safe, effective, humane, and financially responsible care.
