PROPOSED / DRAFT — EQUAL TREATMENT, CHILD SAFEGUARDS & SEX-BASED PRIVACY

Gay and lesbian Americans are entitled to the same civil rights, personal safety, due process, and freedom to form adult relationships as every other American. Violence, threats, harassment, and unequal enforcement of generally applicable law are unacceptable.

Government and schools should protect every child from bullying while neither compelling children to affirm contested beliefs about sex and gender nor concealing material health, disciplinary, or educational information from parents, except under a narrow court-ordered or imminent-safety exception.

No medical intervention whose primary purpose is gender transition—including puberty blockers, cross-sex hormones, or transition surgery—should be performed on a person age 18 or younger. Care for patients ages 19 through 24 should proceed only with extreme caution, extended assessment, documented capacity and informed consent, screening and treatment of relevant coexisting conditions, and a clear explanation of alternatives, uncertainties, risks, fertility effects, and potential irreversibility.

Before any irreversible gender-transition surgery at any age, an independent review board should document approval. The board must include a licensed medical doctor, a licensed psychiatrist, and an appropriately qualified surgeon. Review must be individualized and clinically independent, not an ideological test. These standards do not restrict treatment for cancer, injury, infection, congenital or intersex conditions, or another non-transition medical indication.

Sex-based privacy and safety rules may be maintained in multi-user bathrooms, locker rooms, showers, shelters, prisons and detention facilities, schools, and other intimate settings where biological sex is materially relevant. Institutions should also provide reasonable single-user or private accommodations where practical so no person is denied safe access. Placement policies must separately address privacy, safety, vulnerability, and individualized risk rather than using one rule for every setting.

Women’s competitive athletic categories may use biological-sex eligibility standards to preserve fair competition, with separate or open categories encouraged where practical.
