Lawful Immigrant Self-Sufficiency & New-Citizen Benefit Eligibility

PROPOSED / DRAFT: LAWFUL IMMIGRANT SELF-SUFFICIENCY & NEW-CITIZEN BENEFIT ELIGIBILITY

POSITION

America should welcome lawful immigrants who come to work, contribute, assimilate, participate in American life, and build a future here. Lawful immigration must not become an immediate pathway to living from benefits funded by Americans and long-term contributors.

This policy establishes two connected rules. The first governs lawful immigrants who have not become citizens and may be enacted through ordinary federal legislation to the extent permitted by the Constitution. The second preserves the same benefit-eligibility period after naturalization and therefore requires a constitutional amendment.

The existing Noncitizen Enforcement, Eligibility & Removal policy continues to govern people unlawfully present in the United States. Nothing in this policy weakens, replaces, or duplicates that policy.

CORE ELIGIBILITY STANDARD

A person covered by this policy becomes eligible for non-earned taxpayer-funded benefits only after satisfying both requirements:

  1. Completing 20 qualifying years of lawful full-time work in the United States; and

  2. Reaching age 50.

Eligibility begins on whichever date occurs later.

A qualifying work year requires 2,080 verified hours of lawful compensated employment or self-employment during one calendar year. Twenty qualifying years therefore require 41,600 verified hours accumulated across at least 20 separate calendar years.

No more than one qualifying year may be credited during any calendar year. Overtime or multiple jobs may satisfy the 2,080-hour requirement but may not compress the 20-year requirement into fewer than 20 calendar years.

Earned paid leave and paid holidays count as compensated employment hours when they are part of the worker's lawful compensation. Unpaid time, unreported work, unauthorized employment, fabricated payroll, and hours for which required taxes were intentionally not reported do not count.

Lawful self-employment counts when the work, income, hours, taxes, and business activity are supported by reliable auditable records. Government must provide a secure process for correcting inaccurate employment records and crediting work that is proven through lawful evidence.

PART I: LAWFUL NONCITIZEN SELF-SUFFICIENCY

A lawful immigrant who has not become a United States citizen remains ineligible for non-earned taxpayer-funded benefits until the person completes the core eligibility standard.

During the restricted period:

  • The person may recover only verified personal contributions from a program or account that legally permits those contributions to be redeemed.

  • Prior withdrawals, refunds, or payments from the same contributions are deducted from the recoverable amount.

  • Paying general income, consumption, property, payroll, or other taxes does not convert those taxes into a personal account or create a right to a refund or benefit.

  • A contribution made to a pooled program that is not legally redeemable does not create a right to early payment.

  • Taxpayer-funded cash assistance, food assistance, housing assistance, nonemergency public healthcare, unemployment benefits, Supplemental Security Income, public disability payments, refundable tax credits, subsidies, grants, publicly funded tuition, student aid, training assistance, and other non-earned benefits are unavailable.

  • Naturalization does not erase fraud, unpaid restitution, a lawful sponsor obligation, or liability arising before naturalization.

This part should be enacted through ordinary federal legislation to the maximum extent constitutionally permissible.

PART II: NATURALIZED NEW-CITIZEN BENEFIT AMENDMENT

A person who immigrates to the United States and later becomes a citizen through naturalization remains subject to the core eligibility standard established at lawful admission.

Naturalization does not cancel, shorten, restart, or otherwise alter the requirement to complete 20 qualifying years of lawful full-time work and reach age 50.

Until both requirements are satisfied, the naturalized citizen remains ineligible for the non-earned taxpayer-funded benefits identified in this policy and may recover only verified personal contributions that are legally redeemable.

The person otherwise possesses the constitutional rights, voting rights, legal protections, civic status, and responsibilities of United States citizenship. The temporary distinction created by this proposal concerns eligibility for non-earned taxpayer-funded benefits.

Once both requirements are satisfied, the person becomes subject to the same benefit-eligibility rules that apply to other citizens.

Because existing Supreme Court precedent generally treats naturalized and native-born citizens as possessing equal rights, this part must be submitted through the constitutional-amendment process rather than represented as safely achievable through ordinary legislation.

PERSONALLY FUNDED $10,000 RETIREMENT DEPOSIT

A person who immigrates to the United States does not receive the taxpayer-funded initial $10,000 retirement deposit established for qualifying Americans under the Social Security, Senior Security & Retirement policy.

The immigrant must fund the initial $10,000 deposit using verified lawful private funds. The deposit:

  • Receives no taxpayer funding, public subsidy, government matching payment, refundable tax credit, reimbursement, or government-backed loan;

  • Is not deductible from taxable income;

  • Is treated as the immigrant's personal contribution;

  • Follows the same investment, age-70 withdrawal, account-protection, and death-allocation rules that govern the protected retirement system; and

  • May not be disguised as a public benefit, government contract payment, fraudulent reimbursement, or prohibited employer charge.

For an immigrant child, the child's parents, legal guardians, sponsors, or other family members are responsible for funding the $10,000 deposit from verified lawful private funds. If the family does not fund the deposit, government does not replace it with taxpayer money.

Naturalization does not create a retroactive right to the publicly funded deposit or reimburse a privately funded deposit.

DISABILITY BEFORE QUALIFICATION

Becoming disabled before completing the core eligibility standard does not create eligibility for non-earned taxpayer-funded cash assistance, public disability payments, Medicaid, or continuing government assistance.

The following are not classified as non-earned taxpayer-funded welfare and remain available according to their lawful terms:

  • Private disability, health, life, or other insurance purchased by the person or provided as earned compensation;

  • Workers' compensation for a work-related injury or occupational illness;

  • Earned veterans' and military benefits;

  • Wages, employer compensation, personal savings, privately funded retirement assets, and legally redeemable personal contributions;

  • Damages, restitution, or compensation owed because another person caused harm;

  • Voluntary assistance from family, churches, charities, and private organizations; and

  • Emergency medical screening and stabilization, communicable-disease control, and other limited public-safety services preserved by this policy.

No government agency may relabel a prohibited benefit to evade the eligibility standard. No agency may relabel private property, earned compensation, insurance proceeds, workers' compensation, legal damages, or charitable assistance as public welfare in order to confiscate or deny it.

PUBLIC-SAFETY SERVICES

The following remain available during the restricted period because they protect the public or preserve constitutional process rather than provide ordinary welfare:

  • Emergency medical screening, stabilization, and necessary transfer until the emergency condition is stabilized;

  • Communicable-disease testing, treatment, vaccination, quarantine, and containment when necessary to protect the public;

  • Police, fire, emergency response, courts, criminal justice, and constitutionally required proceedings; and

  • Access to notice, evidence, counsel where constitutionally required, an impartial decision, and judicial review.

Receiving a public-safety service does not create lawful status, shorten the eligibility period, or establish continuing eligibility for a nonemergency benefit.

RETROACTIVE APPLICATION TO THE MAXIMUM LAWFUL EXTENT

This policy applies to future applicants and, to the maximum extent constitutionally permissible, to lawful immigrants and naturalized citizens already present in the United States on the effective date.

Verified lawful full-time work completed before the effective date counts toward the 20-year requirement. A person who has already completed 20 qualifying years and reached age 50 satisfies the core eligibility standard.

For a person who has not satisfied both requirements, future non-earned benefit payments may be suspended or denied after individualized notice, verification of immigration and naturalization history, calculation of qualifying work, and completion of the applicable review process.

Retroactive application may not:

  • Demand repayment of a benefit lawfully received before the effective date unless the payment was obtained through fraud;

  • Confiscate a private account, personal contribution, insurance benefit, workers' compensation award, vested contractual benefit, final judgment, or other protected private property;

  • Disregard verified lawful work completed before enactment;

  • Reopen a final judgment except through an existing lawful procedure; or

  • Eliminate notice, evidence disclosure, an impartial decision, appeal, or judicial review.

The naturalized-citizen portion takes effect only through a duly ratified constitutional amendment. Until ratification, government may enforce only the lawful-noncitizen portion and other provisions independently authorized by existing law.

INDIVIDUAL ELIGIBILITY & ANTI-EVASION

Eligibility is determined individually. Marriage, dependency, household membership, sponsorship, or relationship to an eligible person does not transfer that person's work credit or benefit eligibility.

Changing visa category, adjusting status, naturalizing, leaving and returning, changing a name, transferring employment, dividing payroll among related entities, or using an intermediary does not erase verified history or accelerate qualification.

An employer may not underreport hours, misclassify a worker, conceal payroll, or manipulate schedules or records to prevent the worker from receiving qualifying credit. A worker may not use fabricated work, false payroll, identity fraud, sham self-employment, or concealed unlawful employment to obtain credit.

VERIFICATION, DECISIONS & APPEALS

The responsible federal agency must maintain an accurate, privacy-protected record of qualifying years and verified hours using lawful employment, payroll, tax, immigration, and naturalization records.

Each covered person must be able to review the record and submit lawful evidence of missing or inaccurate work. Government may request only information reasonably necessary to determine eligibility and may not use the system for unrelated political, religious, ideological, or general surveillance.

A clear record error must be corrected within 15 calendar days after sufficient proof is received.

For a disputed eligibility decision:

  1. The agency must issue a written initial decision within 30 calendar days;

  2. An independent administrative appeal must be completed within the next 30 calendar days; and

  3. A final complaint or supervisory review must be completed within the next 30 calendar days.

On day 91, administrative remedies are exhausted and the person may seek judicial review. Transferring, renaming, closing, or reopening the matter does not restart the clock.

FRAUD, ERRORS & ACCOUNTABILITY

Benefits obtained through intentional identity fraud, fabricated employment, concealed disqualifying information, falsified records, or knowing material misrepresentation must be stopped and recovered through lawful restitution.

A responsible person who knowingly commits fraud, theft, bribery, obstruction, evidence destruction, identity theft, or another independently defined crime remains subject to the ordinary civil and criminal law. An honest clerical error, reasonable reliance on an apparently valid record, or good-faith disagreement does not create criminal liability.

Government officials and contractors who intentionally falsify qualifying work, approve prohibited benefits, conceal ineligibility, destroy records, retaliate against a complainant, or obstruct an audit are subject to the applicable restitution, discipline, removal, debarment, civil penalties, and criminal referral authorized by the underlying law.

WHAT MPA WILL MEASURE

Public reporting should track lawful admissions, naturalizations, qualifying work years, verified hours, eligibility dates, privately funded retirement deposits, benefit applications, approvals, denials, public-safety services, record corrections, appeals, reversals, fraud findings, restitution, administrative cost, and the fiscal effect of the policy. Reports must protect personal information and lawful security interests.

Core MPA standard:

America welcomes lawful immigrants who come to work, contribute, assimilate, and become Americans. A person who chooses America should help build America before relying on non-earned benefits funded by its people. Citizenship provides full membership in the nation, but it does not erase the self-sufficiency obligation accepted through immigration.
